Small & Disadvantaged Business Enterprise Program

The Department of Transportation (DOT) is dedicated to serving our community, including those businesses contracting with state agencies and recipients of DOT funds. The Department's Disadvantaged Business Enterprise (DBE) program is designed to remedy ongoing discrimination and the continuing effects of past discrimination in federally-assisted highway, transit, airport, and highway safety financial assistance transportation contracting markets nationwide. The primary remedial goal and objective of the DBE program is to level the playing field by providing small businesses owned and controlled by socially and economically disadvantaged individuals a fair opportunity to compete for federally funded transportation contracts.

The Departmental Office of Civil Rights (DOCR) enforces civil rights laws and regulations, which prohibit workplace discrimination on the basis of race, color, national origin, sex, disability, religion, age, genetic information, equal pay compensation, and reprisal in employment and the provision of government services.

This supplemental guidance serves to assist Central Region airport owners and their consultants with obtaining and administering an Airport Improvement Program (AIP) grant. Users of this guidance shall note that requirements for AIP participation are established within applicable United States Code, Public Law, Federal Regulations and official FAA policy. The supplemental guidance and best practices provided within this guide is not intended to create additional participation requirements over and above that established by statute, regulation or official FAA policy. The Office of Small and Disadvantaged Business Utilization (OSDBU) ensures that small businesses, including disadvantaged business enterprises (DBEs), are provided maximum opportunity to participate in the USDOT contracting process. This includes ensuring that small businesses and DBEs receive valuable technical assistance, develop relationships within the industry and have the opportunity to compete for USDOT funded contracts.

ADOT has established a Disadvantaged Business Enterprise (DBE) program in accordance with the regulations of the U.S. Department of Transportation (USDOT), 49 CFR Part 26. As a condition of receipt of funding, ADOT has signed an assurance that it will comply with 49 CFR Part 26. It is ADOT’s policy to ensure that DBEs, as defined in Part 26, have an equal opportunity to receive and participate in USDOT-assisted contracts.

The Engineering Consultants Section (ECS) seeks to ensure compliance with the regulations of the U.S. Department of Transportation (DOT), 49 CFR Part 26, through proper contract execution and successful management of all DBE contracts.

ECS is committed to providing proper advertisement, fair and reasonable award selection, and other measures to ensure that DBE requirements are met.

Title VI of the Civil Rights Act of 1964 is the main legal authority for the Arizona Department of Transportation's external nondiscrimination programs. ADOT's Title VI Program includes the American's with Disabilities Act (ADA) and other nondiscrimination statutes that prohibit discrimination on the basis of race, color, national origin, age, sex, or disability in programs or activities receiving federal financial assistance. Once an agency accepts federal funds, all of its programs and activities are covered, regardless of their funding source. Related statutes and presidential executive orders under the umbrella of Title VI address environmental justice (EJ) in minority and low-income populations and services to those individuals with limited English proficiency (LEP), women and the disabled.

Additional protections are provided in the Scottsdale City Code for religion, sex, disability, age, sexual orientation, and gender identity for City employment. The City of Scottsdale strives to ensure nondiscrimination in all of its programs and activities, whether those programs and activities are federally funded or not. As a subrecipient of federal funding, the City of Scottsdale is responsible pursuant to 28 Code of Federal Regulations (CFR)§ 42.401 et.seq. and 28 CFR§ 50.3 and the U.S. Department of Transportation Title VI implementing regulations at 49 CFR part 21 and Ord. No. 02014.10, 2-27-14.
